On June 30th, 2008 the Highly Skilled Migration Programme (HSMP) has been replaced by the Tier 1 – Points-based system.

Like the HSMP the Tier 1 is designed to allow highly skilled people to migrate to the United Kingdom to look for work or self-employment opportunities. Basically, the Tier 1 is similar in a way to the skilled migration programmes Canada and Australia offer. Applicants’ eligibility under the Tier 1 is based on a points system too.

In general the Tier 1 status gives you right to get settled in the UK and normally leads to permanent residence at the end of four years. The Tier 1 rout is different from the work permit option as it does not require an employer to obtain a permit for the applicant. It is also different from the other existing business categories as it does not demand a detailed business plan or investment in the UK.

How to Apply for the Tier 1

You may apply from either within the UK (unless you are in the UK as tourist or visitor) or from your country of origin/official residency.

You must be eligible:

• Proficiency in English;
• Proof that you can support yourself without using UK public funds;
• Score 75 points for your attributes (age, qualifications, previous earnings, and experience in the United Kingdom);

You must pass the points test
On 30 June 2008 the Tier 1was introduced and the overall points score required for approval was set to 75 points, plus 10 points for proficiency in English and 10 points for available maintenance (funds).

Once you have been approved under the Tier 1 you should apply for one of the following:

• an entry clearance to come to the UK (if you are out of the UK) or
• a leave to remain (if you are in the UK).
